What is The Federal Law for Lead Based Paint?

Before renting or buying a pre-1978 home or apartment, federal law requires: 

  • Sellers must inform potential buyers of any known information on lead-based paint or lead-based paint hazards possibly present before selling a house. 
  • Real estate sales contracts will/must include a specific warning statement about lead-based paint. Buyers will then have up to 10 days to perform a lead inspection if they so choose. 
  • A recent change in New Jersey law regarding lead-based paints created a requirement for a visual LBP Risk Inspection and/or Dust Wipe Sampling inspection for all rental dwellings. 
  • Starting July 22nd 2022, rental properties built on or before 1978 that lack a lead-free certification require a visual and/or dust-wipe sample inspection prior to any new rental occupancy. 
  • For rental units that are already occupied, rental units are required to be inspected within 2 years from the issuance of the mandate; meaning a deadline of July 22nd, 2024.

lead based paint test

A lead-based paint inspection tells you if your home has lead based paint and where it is located. This includes all paint layers within 10mm (in optimal conditions). However, it won’t tell you whether your home currently has lead hazards. A trained and certified lead-based paint inspector, will conduct a paint inspection using methods, such as: 

 

  • X-ray fluorescence (XRF) machine 
  • Paint Chip Laboratory Analysis

A risk assessment can also tell you if your residence may currently have lead hazards from lead paint; whether the concern be chips, dust and/or soil. It will also provide you what actions may be required to address any hazards. Point Enviro’s trained and certified testing professional, called a lead inspector/risk assessor, will: 

  • Collect samples of paint that is in decay on doors, windows, floors, stairs, and walls 
  • Collect sample of possible dust near painted surfaces 
  • Obtain laboratory testing of paint, dust, and soil samples
